The estate of Brian Barlow appeals from an order of the district court dismissing Barlows civil rights action for failure to substitute the estate within the 90 day period provided by Federal Rule of Civil Procedure 25(a)(1). The district court had jurisdiction pursuant to 28 U.S.C. §§ 1331, 1343, and we have jurisdiction over this timely appeal pursuant to 28 U.S.C. § 1291. We reverse and remand.
